One of the creators of my forum. Ad a lot of payd stuff to a house to download...
Now the "owners" of this pay stuff are bulling us... or triying at least...

This is what they said:


Hello this is Flem from Holy Simoly. Your lot has items from our donation pack in it, please remove these items from this lot thanks. Great house by the way.

and

please remove my objects from your house.
I donīt give permission to include my objects in downlaodable houses.
Only the build objects like windows and doors may be included.

That paysites are illigal isnīt a fact itīs just an opinion of some filesharers who just want to legalize there piracy. Itīs just a fact that EA knows about paysites since more than 6 years and didnīt ever had a problem with them. They even work together with some of them and already invited them to the fandays to L.A.


B.tw. this isnīt Malysia itīs Europe and I just have a copyright here on my creations and I will use it if neccessary.
I hope this will not be needed, just let us have respect for the creations and efforts of all community members.

Put down:
"Well one, the person that sent you the message was DOING the illegal activity, selling pixelated content which BELONGED to a company called EA which explains very clearly that content should be shared freely and not for commercial use,"
Give them the EULA for proof.

Edit: Also the reason why PMBD is up is because A: They live in malaysia and B: privately owned server (Someone please explain it better than me!)

If that happens and there's no way to agree with the provider of the server then I'd suggest: http://www.fffss.org/, it will find you another server at a very cheap price or freely however see how it goes

Most providers will not close a website without proof of law-breaking. All you'd have to do is explain that the complainers are, in fact, legally in the wrong, and then elaborate to show the ridiculous stalemate we're in - they could still call on the "we reserve to right to terminate any and all services at any time at our sole discretion" clause, but they're far less likely to do that if they can see the ridiculous amount of controversy surrounding the issue.
Given that you're not an expert at legal wordiness in English, I'm sure you could get someone here to write that for you :wink:

Maybe even me if you give me enough rum....

Ahh, that drama with them all the time!  :roll: Before I found that site here I had no clue how much paystuff I already had through Lots and Sims! As we all know exactly about every rule that is on any single item out there!!!!  
Approcing you like that is just rude! :evil: They should better worry about their illegal activities, be it against EA laws and also about running a kinda shady backyard shop not paying taxes and stuff instead of sniffing through the net to locate files.

I'm sure this is going to be an unpopular comment.  

All paysites are illegal, but aren't some more illegal than others (so to speak)?  Holy Simoly has contributed lots of extremely high quality free stuff, which has been recolored and downloaded by a ton of simmers.  They have, as far as I recall, only two donation sets.  Contrast that with a nearly all-pay site like Peggy's or a pay-if-you-don't want shit site like TSR.  I don't see antagonizing Holy Simoly.  They're not big players in this paysite fraud, and they provide sizeable benefit to the sims community. If it were me, I'd remove Holy Simoly's stuff from downloadable houses simply out of respect for what they're done for all of us (the case isn't the same with Gedoehns).

I had this same argument in an earlier thread and to be honest, I now don't hold the same thought any longer. Paysites are paysites, whether one is more flagrant than the other or more prolific, makes no difference. They all charge you outside of the allowable in the ELUA. It really doesn't matter if someone is nice or not as big, in the end they are making money outside of the allowable. Fraudulent activities happen, whether they be big or small in the eyes of the ELUA, it is all the same. It does not state that if you only have one or two pay files that you are not violating it, violation is violation.

Actually that is not 100% true. In the ELUA it says you can ask for DONATIONS to maintain a site, it does not say you can SELL items for "DONATION" to maintain a site. That is the fine line that the smaller paysites are operating under.

In other words, if HolySimoly were to take the donation button off of her objects/packs and they were able to be downloaded by anyone, at any time and then placed a donation button asking for site donations on her pages, and then kept records of the site's costs,  this is legal according to the ELUA. Much like some of the free forums/sites do.

Having the actual objects/packs themselves for "pay/donation" is no different than what the big guys do, no matter what the money is being used on.

I realize that the smaller, less affluent sites probably are using the money for site upkeep, but the method of "donation" is illegal according to the ELUA. It is as simple as that.

AND as Denimjo once told me in a thread before I read all the information out here...

(paraphrased) Sometimes the good will go down with the bad if they are walking that same line. If "she" is so nice and kind, talk her into changing her ways or she will go down with the rest of them.

Sadly, she was 100% right. I have heard that Holysimoly is the nicest person out here (I personally have never spoken to her), but she is doing things the illegal way. What can you do if she won't change her methods? <shrugs>

Anyway...HolySimoly is as illegal as any other paysite...it doesn't matter how many items they have...one is enough to be marked as illegal.

However, in the terms of "greedy", HolySimoly is definately on the better side.


This does not mean, though, that it's okay what they're doing. I don't like HolySimoly. I don't like paysites in general. They are all illegal. Period.

K maybe my post wasn't detailed enough, because its point was missed.

Any commercial net via a simsite, no matter how it is obtained, is what is illegal by EA's EULA.  If a website has a donation button with no strings attached, or a payment button in direct/obvious exchange for an item -- if the website is making a commercial profit, they are achieving it with EA's product as the vehicle.

If Holy Simoly, or any site, has record that monies obtained via the website have only been put toward costs, and not for any other purposes, then they are not breaking the EULA.

As a user of bodyshop and/or homecrafter they are permitted distribution, and have the basic right themselves to offer a package discriminately.  They cannot impose others to be discriminate however, in particular those who have received the package (ie Yunalesca, as others have stated, they can't shut you down).

So.. PMBD = Perfectly legal, no new news there.  The server doesn't even need to be in Malaysia.  Holy Simoly = not sure, dunno if they've turned commercial profit, that's EA's business to find out.

Hope that clears my post up... and now I'll go back to light hearted threads, heh.

Y have donate money for free sites, 3 euros in the one that i like, i will be more that happy to donate money to does that don't sell their stuff.

About Hoolly Simolly... i still think even they aren't the big bad... they still having no rigth to ask money for products even if is only to mantain the site... thereīs other ways to mantain siteīs open.

If you canīt afort broad band or whatever, just upload your stuff to plces like mega share and all does places like the "foreros" do...

Your post was clear, it's just wrong. It doesn't matter if a donation item's revenue is provided to bandwidth and only bandwidth. The item is withheld from the populace unless money is paid. This means that the item is a pay item, and the paysite is actively charging for the pixels. Which makes it bad.

Now, you can put a donation button on a website and that's cool. You can put so many donation linkies on a site you can barely see the content. No problem. You can even make more moneys from donations than you need to clear your costs. You just can't make something with EA's crap and wave it in front of people, then say "Nope, give me money first!"

I still don`t understand why HolySimoly gained the pirates` favor - or should i say blessing?  I mean, they do the exactly the same things your average paysite does and still is excuse by almost everyone here. If not totally excused, their actions are taken lightly.

Really, they sent a `cease & desist` letter to a fellow pirate and there were members that came forth and patted them on the head. Even if they had ZOMG, WONDERFULLLL content that outshone every other creator in the community - which isn`t the case - they would still be in wrong. HolySimoly is still a paysite that frowns upon fileshares and sends little `cease & desist` (i like this expression!) email.

Why do we back them up?
Because their stuff is shinier?
Because the owners are suave?
BECAUSE THEY ARE A CULT? (!?) I WANT MY WEBCAM NOW.

P.S.:  Even  the self proclaimed neutral Better Sims Bureau seems to glorify this site. It gave the `maximum-est` rating on all topics to HolySimoly. The others hardly got a 4 (out of 5) on 2 topics.

Personally, I love Holy Simoly's creations. I am not afraid to admit that. I would donate to them if there weren't so many other free sites that deserve my donations first. Yes, Insim got Holy Simoly's donation. How sad. (Sarcasm!)

I can't speak for others here but until they sent that letter to Yunaleska I'd never heard of them sending out "cease and desist" letters or ever having said anything about their items being shared anywhere before now. So, this is a first for me and it is disappointing.

Indeed, their items are superb quality-wise, but it shouldn't be an excuse to charge for them AND recieve free pass among us.

I totally agree with you, TheVanity. It shouldn't be an excuse for them to get a free pass from us. They won't be getting one from me any longer.

As for the donation:

I gave the donation I was going to give to Holy Simoly to Insim instead.  It's better to support free sites than paysites regardless of how much I love their stuff. :)

The only way I've seen a site do "donation items" in an acceptable fashion is XMSims' way.  You get it a month before everyone else if you donate or are a creator.  If you want it for free, wait a little while and there it is.

I'm guessing the tentativeness toward HolySimoly is due to the quality and craft of their free stuff, of which there is much.  Yes, technically they come in under the paysite category for those 2 'donation' packs (which I purchased literally 10 minutes before I found out about the Booty).  I rationalize - 10 bucks US for lots of stuff I always use, versus whatever Maxis stuffpacks cost, stuff I won't touch with a barge pole.

The cease and desist letter is disheartening, only because it seemed they were staying out of this whole thing.  They can't possibly not know about the Booty - but the Booty's been paid for...I'm rambling, sorry.

I found it interesting that they recently put their 50's fridges up for free after revamping for Seasons - they were formerly part of a donation pack.

I would like to see a list of all sites with traffic and dollar amounts so you would know who needs the donations. I think most people would donate more if they could actually see where money was and was not needed. If every site was free, I don't see how it wouldn't work. You know we aren't going to watch a place close because of bills. It's a lot different when you don't know how much profit someone is getting , or worse when you kind of do know. (like TSR)

Holy Simoly is way better than most. I'm not really an anti paysite fundamentalist, so I don't feel the need to draw such sharp lines. If all paysites were like Holy Simoly, with 2 small donation sets and oodles of great, free content, this site would never exist.

I was considering donating to them anyway, but the cease and desist letter bothers me a lot. I wish they would stay out of the fray.

Mm, well, people would still want to fileshare since there would still be that exclusivity going on, and some of the site owners would get butthurt about it, even if they only have one or two donation items/sets.  (Like Retail Sims.)

I think their attitude and behaviour has a lot more to do with it than how much money they're raking in, although that is definitely a point of interest.

Well, I use a good P2P prgram called Foldershare, and "own" and moderate a few Yahoo groups, and a few of my yahoo pals have suggested at times, starting a Sims 2 group, posting downloads for a month at a time, then rotate them into Foldershare. That way we wouldn't use up all the files storage space at Yahoo groups, and could "recycle" the storage, so to speak. And the previous downloads could come from anyone who also had Foldershare in the group, and had it running. I'm still kicking the idea around, though.

I didn't mean to imply that, sorry :oops:, I know you have given them credit. It's just that Exchange is hated by all paysites, even more now that the meshes go with the objects and there's nothing they can do to stop that. There's a part in me that would love to see them trying to convince Eaxis to delete your lots from their database. :lol:
