1  The Pirate Ship / ARR! / Will paysite creators ever be welcome back in the community? on: 2007 June 26, 08:11:02
I probably wouldn't be able to tell the difference from a former paysite owner and anyone else, it would really all depend on how they come off to me at the time.  I've never actually not been able to acquire any piece of software or digital media free of charge for as long as I can remember and the few things I've downloaded from here were simply a faster means of acquiring some TS2 content than simply mentioning to the guy I let drive a small tow-hitched trailer full of DVD's out of my driveway every week.  If I could care less about such a thing I surly would.
  Get a life!

Ahh, See...  EA helps sometimes with sites illegally making money off content that is property of someone else.  Make sure you carefully read the terms they will have you agree to in exchange for such help (threats they will make towards TSR) - they will stake a legally binding claim to your work in it and if you agree, you are bound.

Anyhoo... Point being: You can't make everyone happy and do they really want to be known as a company who won't enforce their own rules?

EAxis' rules are the same as any large company. A. Maximize profits in the short term, while B., attempting  to insure profits for the future. Guess which has priority?
The paysite issue is a non-issue to them. They throw a token bone to each side.
They allow and encourage filesharing, yet continue to provide free advertising for paysites. That is giving tacit approval to both sides.
Fence sitting is all it is.

Oops...

[end/ derailment]

Fence sitting?..  Don't fool yourself, it's called recruiting.  EA is exactly sure of the legal ramifications of their EULA (they had floors of lawyers draw it up) and they are exactly sure how most of the masses will interpret it (they had floors of psychologists draw it up).
The reality of the EULA situation is: "EAxis" is not allowed any ownership or rights of any files compatible and/or usable in conjunction with their game insofar as they were not created with any of their tools and do not contain any of their content ('materials').  Copyrite law as applicable to computer software does not, in fact, grant any right to anyone who cannot prove that written code was actually stolen, even if the code in question is written exactly as the original copyrited code.  That is to say that if you create a piece of CC from scratch and it turns out to be exactly the same as one that shipped with the game, the burden of proof would be on EA if they were to contest the notion that one did actually come up with the content them self.  This CC issue that most of you base on your misinterpretation of a legal document on (the TS2 EULA) seems to be the basis of your piracy.  Please, get an education, look it up, go to a law library, hire a lawyer and ask it about this, or, for god sakes Just Step Up And Be Honest With Yourself And Everyone Else - You Are Doing This To Get Free Shit That You Don't Want To Pay For!
Really, you people claim to be pirates?  Well, you are but you should stick to that instead of hiding behind a lie and convincing others of it by interpreting the shady (but legally sound) wording of the EULA.
I don't see you offering up ISO's of the TS2 game itself...  Some Pirates, Hah!  It seems to me that over here the only thing pirated is stuff stolen from people who have no means of providing themselves with the legal recourse necessary to do something about it, and why?  Well you know why - like I said.  Don't get me wrong - I am not against piracy.  I actually I think though that the webmasters of this site propagating the propaganda that all mods are property of EA, considering that they do have such an amount of legal knowledge to host the site on the servers they do and use such other methods (which I will not expose) to cover their asses, is an outrageous display of irresponsibility - BAD FORM - They have certainly demonstrated that they do know what rights EA has regarding Custom Content.  A pirate shouldn't feel any need to rationalize or justify thievery with anything, much less lies - Otherwise the pirate is not truly free.

Someone ought to go post a new topic over there asking just that.
5  The Pirate Ship / ARR! / Sim Slice on: 2007 April 03, 20:51:05
There's little there worth downloading, even if it is free.  There are so many other objects that do what the candles do available free from other more competent and reliable modders.
You're right Lorelei, all simslice has really been doing since it went pay is selling essentially borowed credibility.  I hate all TS2 paysites but really the    morality (or lack thereof) of what most of them are doing is really a matter of opinion - in the case of simslice it in not a matter of opinion, what they are doing is just wrong.  They are knowingfully taking advantage of suckers and the thing is that stupid people really can't help it if they are stupid, so simslice is essentially exploiting the helpless for their own monetary gain and they know it - that's just wrong any way you look at it.  Back in the day their TS1 incentive packs used to be guaranteed for quality and dissatisfied customers could get back their money.  I see nothing on their site that indicates that they are currently conducting business in such a reputable fashion.  Does anyone know of anyone who has actually gotten a refund from simslice?  I know would want a refund if I had paid for their stuff because everything I have seen from there is either broken or not as advertised.
They need to be destroyed!  The destruction of SimSlice should be considered a higher priority than the destruction of other paysites for this reason:  There are no legitimate arguments or points that could be made in favor of the idea that Simslice isn't conducting a dishonest business.

We don't know how much money is being given to Delphy and what it is being used for.  What I do know is that when Delphy does try to take a break the site crashes and stays that way until he returns.  He does put a lot of work and time into the site.

We do know that the site brings in enough money for Delphy to have been unemployed for over a year.  He even admitted this.

Yup, same for me - different handles different places and always myself.  I think this is true for most people.  However, this is not in any way supportive of a theory that Lois and Nathan are the same people - or that they are different people.  The general MO of the online community is completely unrelated to such an issue.
If someone were to premeditate a scam like this it would be in their best interest to create a completely new and separate persona (or two).  This scam is too obviously a scam and whoever is behind it would have known that only a certain percentage of people would actually donate money and a certain amount would see right through it.  Someone has to be the fall guy, even if all parties involved are silent from here on out (the community will form their perception about it anyway).  Naturally it will be assumed that Delphy is doing something dishonest, but at this point, if he remains silent there will be room for doubt.  The money has already been scammed/received.  No matter what happens, in the end Delphy can always just take the stance: "I had to eat the bill whilst being considered to be behind a huge scam - but I guess that's just par for the course for someone in a position such as mine.  It's not easy running such a huge site and your going to run into something like this every so often."  He could even go so far as to say something to the effect that he paid the bill and Nathan said he'd raise the money to pay him back, showed him how he was going about it and stiffed him.  Half the suckers who bought the scam would probably feel bad for "poor Delphy" and go donate to something to MTS2 on top of it.
It could be that Nathan simply dropped off the face of cyberspace a year ago and Delphy just adopted his persona.  He is a kid, he could have just lost interest the moment he got his drivers license or something.  When I got mine I had the Hot Rod of gaming PCs, you sort of have to to play these games efficiently enough for them to be fun - I sold it that day.  The next day I bought a junker of a car...  Didn't touch a computer again for over ten years.
Whatever is really going on it does look like Delphy is doing something shady (again)...  And it looks like that for a reason.  Delphy is doing something shady, again.
