Title: They Just Don't Learn.. *set now pulled!*
Post by: missangelica on 2007 June 09, 17:12:09
Another paysite dumbass is trying to sell another food business and this time it's Subway.  You think they would learn from seeing the Starbucks and the other one being taken down (Krispy Kreme?)..

http://www.sims2-studio.de/

Who would you contact to report this sort of thing?

Well, someone better grab it and stow it away before Subway smacks em with a cease and desist. Seriously, McDonalds, Krispy Kreme, Starbucks... you'd think paysite owners would learn you can't fuck with corporations, they take copyright infringement seriously.

Well, except EA.

I contacted Subway Customer Service and gave them direct links to the site's pages selling their copyrighted logo.

You can contact them too at:

LOL
you guys are made of pure evil

Hmm seems that sims2-studio is from Germany. It may be a little bit more difficult (read: bureaucratic) for Subway to prosecute someone outside the US.

We're evil?  We are not doing anything wrong!  They do not have the right to sell someone else's product for their gain.

Cease and desist is usually enough for them to pull it down.  Although more difficult I don't doubt that they could still sue them.

Depends - if Subway is multinational, and I believe they are, they shouldn't have a problem - also, I believe that Germany honors American copyrights?

The pic missangelica put up has changed to something else. Does this mean they've pulled the set?

They have. Too soon to have got their wrists slapped? Hot-linking to their image probably gave them a heads-up if they checked their logs and followed it back to this topic.

Post by: missangelica on 2007 June 09, 21:17:32
Yep, exactly why I hotlinked, Capucine.  I want them to find this thread.  I want paysites to know that we are watching them and we will report them when they pull stuff like this.  Even if we can't get EA Maxis to take a stand, I know these corporations will!

ETA:  How did I find out about the set?  I watch N99's "Hot Downloads" where site owners advertise.  Here (http://p218.ezboard.com/fstarlightsimsfrm68.showMessage?topicID=23104.topic) is the original thread that I saw it on.

For those that don't have access to N99 she changed the name of the thread and removed the set image and replaced the text with this.

I only sent Subway the links to the donation pages, which she has now removed. So, if they were slow getting there to see all they're going to see is the new replacement set. You may want to send those images to them if you really want to press the issue.

Title: They Just Don't Learn.. *set now pulled!*
Post by: missangelica on 2007 June 09, 21:51:42
Nah, the point was for her not to be able to sell it.. if she doesn't then I won't push the issue.  If she tries again, I will contact Subway again.

Foodway...wow...lame.
I would assume that a restaurant named Foodway would serve...food. Not just subs. Subway would serve just subs.

To Missangelica: WELL DONE. Brava!

To Marilu: you idiot. I notice you had to put that short-lived set on your personal site...did TSR reject it for copyright issues? Shoulda been your first clue.

To darkangel: I am not sure if it's still up, but there was some good Starbucks stuff up at MTS2, with a reasonable justification for its existence. If it's gone, let me know and I'll pack it up for you.

So Marilu posted this on my Live Journal:

Quote
Also erstmal nachdenken bevor man die Klappe aufreisst.

Ich schreibe auf diesem Weg weil Ihr ja so feige seid und Euch verschanzt, anderenfalls könnte man sich ja bei Euch anmelden aber Ihr redet lieber hinterrücks über andere, einfach nur arm.

While I got the general gist (Marilu, I'm not completely ignorant of the German language), Gwendolyne quickly translated for me:

Quote
You can have this translated by one of the bitches (Gwen: does she mean me?) in mustnotbenamed forum. There are enough spies over there that speak German. Only for you I do not translate this in English. About my set- yes, as you have noticed I changed the texture. And before you call me idiot, hmm.

Quote
Eigene Nase fassen

That is a phrase like "Look what you are doing wrong yourself before pointing on someone else"

You want to blacken me at subway because of the copyright and do copyrightinfingement on grand scale. Thousands of clothes you spread through the booty list violate copyrights and you incur to penalty by this publishing. So think first before you bitch around.
I write this way as you ("all") are so cowardly to barricade/hide, otherwise I could register, but you prefer to bitch behind others backs.

Gee...if I was bitching behind her back, I'd have only written about it to you all in a PM...I mean, obviously she's reading here, so I thought I was being pretty forthright.

I don't feel barricaded at all, by the way, do you?

Post by: Marhis on 2007 June 10, 14:57:31
What an idiot, indeed.

She doesn't understand that using trademarks for FREE stuff distribution is more like free advertisement, while SELLING trademarked stuff is a completely different can of worms, from the copyright holders point of view?

If you're into business you have to understand very, very well how to deal with this stuff; but wait, they're not into business, right? They're only collecting some tips to help feeding their chilluns. Shame on me.

Also, I wonder in what planet this idiot lives; in this planet we certainly are not hiding.

Uhm, I call her an idiot, too, but I have no LJ; how can this poor woman throw shit at me, now? I must be really mean, sheesh.

Title: They Just Don't Learn.. *set now pulled!*
Post by: Hecubus on 2007 June 10, 15:32:54
Marhis, I suppose you could go to her site and call her an idiot there. I did, but she'll probably delete it.

Oh, I called her a "Teutonic twat" in my guestbook post to her. Wonder if she'll get it.

Title: They Just Don't Learn.. *set now pulled!*
Post by: missangelica on 2007 June 10, 18:04:41
Doing it in a public forum is bitching behind someone's backs?  Hmm.  I didn't bother posting in that thread I originally found it in because it would of just been deleted and I know that paysites watch this site like a hawk anyway.

And why did she post that in your journal and not here?  I think it is cowardly of *her* to not write it here!  Nothing is stopping her from registering and talking here, even in German.

Difference between her having it on her site and it being in booty is that ours would be free and hers would not.  So why she is even mentioning that, I don't know..

ETA:  I also use the same username everywhere except for insimenator where I signed up as "angelica". ^^;

And I think it's hilarious that they are calling themselves greedy bitches!  Right on!  You know what you are.  :)  Poor things are probably using it as a "badge of courage" though..

Why does everyone say we're hiding?  I use the same damned user name on all of the forums I belong to, and I know that Nouk and Liegen-whatever (sorry, love, I'm too damned lazy to figure out how to spell your name correctly!) have user names that also indicate who they are, and they're way more well known than I am.  And I know without a doubt there are others of you who are in same boat - Pescado and Ren for example.

So...  How are we hiding over here?  Just because we don't go around saying, "Hi, my name is Fiona Skye, I live in Tucson, AZ at 123 Main Street and my phone number is 520-555-2121", we're hiding?  Hell, I call that common sense, not hiding.  This is a bloody public forum that has links on so many different places - it's not exactly a secret.

So...  I ask again - how are we hiding?  Maybe Ms. Marilu-Britches-in-a-Twist would care to answer?

Post by: Duckie on 2007 June 10, 19:20:22
Oh, I feel terribly barricaded. I feel so barricaded here that I don't even feel the need to use an alias. With all the secrecy, precautionary measures, and hiding we do here I don't see a reason not to use my easily identifiable, easily found on other forums username.

Give me a break.

If that's the best she can come up with it explains very well why she thought she could get away with making money off of another company's copyright. It also makes me giggle that she can't tell the difference between using a copyrighted logo on a free creation and using it on a pay creation.

She's an idiot.

I like using different usernames.  It doesn't matter what my username is here, whether it's Padlock, Kleenix, or any of the other trillion usernames I use.  It wouldn't matter if EVERYONE used the same username everywhere because there's no way she, or anyone else for that matter, could possibly know all of us, so I don't know why that tends to be one of the first things people point out instead of just being offended by the evil filesharing.

Yeah, okay, I'm Padlock on S2C (y'know, in case you couldn't tell by the avatar or anything).  What does that mean to you?  Absolutely nothing.

Title: They Just Don't Learn.. *set now pulled!*
Post by: Duckie on 2007 June 10, 20:22:09
I pointed it out because it means I'm very easy to find. One doesn't have to try to connect various different usernames and guess if it's acutally me if they want to bitch at me. Essentially, if you're bitching at "evilredduckie" anywhere, you're bitching at me.
