Who's scratches did they trace over to get patterns? Just curious.

It seems like it was poorly made from "scratch". Stealing is always an option though, with the proper tweaking.  Wink

That poses a problem for TSR because they can't do a damn thing properly aside from steal your money if you subscribe to them. Ack. *shudders*

Quote from: Sheeperson
Many Many of the patterns being made are using the same textures..the artists get their material from the same places..it cannot be avoided and is Not Stealing just bc someone else made it first!!!
I'm so glad that this was cleared up. It's not stealing, if it's been stolen. Or something.

I can see this argument working if someone was being a douche and accusing someone of stealing something like stripes of alternating color, but come on. Come on.

Stuff I learned on the internet today.

#1 Artists get their materials from the same places thus copying is unavoidable, therefore it's not stealing just because someone else made the exact same thing first.

How about we compile a list of several patterns that TSR failed to credit the original artists for, and post it in various forums?  With pictures for comparison?  And some concise text, nothing too long or involved, something 12s will understand.

- When using someone else's texture, it is only right to give credit.
- Changing someone else's texture a tiny bit does not make it your texture.
- It is wrong to sell someone's texture when they have shared it for free.
- Free creators credit their sources, TSR FAs don't.
- TSR loves to boast how they "respect creators terms of use", but this only applies to their own creators, and it really means "don't fileshare our pay stuff"

Would it be worthwhile to contact some of these texture websites and artists and tell them TSR is selling their work?  I don't think it would result in a lawsuit, but it might get TSR the bad press they deserve.

Yeah, it gets even more serious when it's stolen & used for commercial purposes, especially for the identical ones. That's why most creators mark & sign their textures. It's more like pirating the pirates.

I suppose we could spread some facts, but I read some kind of noise about how we don't have any credibility.

If you can find examples where they took images and made an exact copies, then ya absolutely. Otherwise it gets a bit touchy CatOfWar because unless it's an exact copy it could be claimed as an "inspired by" type thing. However even in that case, it's great way to at least demonstrate that TSR is making you pay for ideas that they got from somewhere/someone else for free and not even having the professional courtesy to credit the original artist for their work. Just themselves.

Kinda like this.

Thanks, kenmtl, for that example.  I understand what you're saying about modified patterns.  I think "inspired by" would fall under "derivative works", and some folks cover those in their TOUs.  There was a pattern in one of the threads here, I'd have to find it, that was a bunch of apples and leaves.  Someone at MTS, purplepaws maybe, made one similar.  They both used a texture they found online.  The TSR creator moved some leaves around a bit.  People need to understand moving those leaves did not make it a whole new texture, the original creator's TOU should still apply.

ok, found the linkies from our threads, and look, it's another one by Apple

warm biscuit bedding, makers of the apple design
(unless they got it from somewhere else too, regardless, if someone used a swatch from warm biscuit, they should credit warm biscuit)

TSR Apple's apple pattern
simcredible apple pattern
MTS purplepaws apple pattern

edit:
Now, to be fair, not all the free creators credited the apple pattern to whoever, so that weakens the argument that TSR should slightly (though it's still a valid argument).  kenmtl is right that the case is strongest when it's a direct copy, like that rectangle motif pattern.

I think this dress is only being held up by my pure, unadulterated hate for it.

The pattern coming together on the side in the mirror is a nice touch.
